Terms of Service

By accessing or using CASTD ("Service"), operated at castd.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms; continued use after changes constitutes acceptance.

CASTD is an AI-powered content repurposing platform that allows creators to upload video and audio content, automatically generate clips and captions using AI models, and publish that content to connected social media accounts. Features include:

• Video upload and AI-driven clip generation
• Automated caption and transcript creation
• Multi-platform social media publishing and scheduling
• Analytics and performance tracking across platforms
• Content vault and asset management

We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.

You own your content

You retain full ownership of all video, audio, images, and text you upload to CASTD. By uploading content, you grant CASTD a limited, non-exclusive, royalty-free license to store, process, and transmit that content solely to provide the Service to you.

You must own or have rights to what you upload

You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to upload and publish all content you submit through CASTD. You must not upload content that:

• Infringes any copyright, trademark, or other intellectual property right
• Violates any person's privacy or publicity rights
• Is defamatory, obscene, or unlawful
• Contains malware, viruses, or harmful code
• Violates the terms of service of any target social media platform

Account security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at privacy@castd.app if you suspect unauthorized access.

By uploading content to CASTD, you explicitly consent to having your content processed by third-party AI inference services (currently Replicate) to generate transcripts, captions, and clip suggestions. This processing is required for core functionality and cannot be opted out of while using the AI features of the Service.

AI-generated outputs (captions, transcripts, suggested clips) are provided as-is. You are responsible for reviewing and editing AI output before publishing. CASTD makes no warranty regarding the accuracy, completeness, or suitability of AI-generated content.

Plans and pricing

CASTD offers free and paid subscription plans. Paid features require an active subscription. Pricing and plan details are listed at castd.app/#pricing and may change with 30 days' notice to existing subscribers.

Billing cycle

Subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. All payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

Refunds

We do not offer refunds for partial billing periods. If you cancel your subscription, you retain access to paid features until the end of your current billing period, after which your account reverts to the free tier.

Free trial

Where a free trial is offered, it converts to a paid subscription at the end of the trial period unless you cancel beforehand. No charge is made during the trial.

Taxes

Prices are exclusive of applicable taxes. You are responsible for any sales, use, or value-added taxes imposed by your jurisdiction.

You agree not to use CASTD to:

• Violate any applicable law or regulation
• Harass, abuse, or harm any person
• Spam, scrape, or automate requests in a way that burdens our infrastructure
• Attempt to gain unauthorized access to any system or account
• Circumvent usage limits or access controls
• Resell or white-label the Service without written permission

The CASTD name, logo, product design, and codebase are the intellectual property of CASTD and are protected by applicable copyright and trademark law. Nothing in these Terms grants you a license to use CASTD's brand or technology except as necessary to use the Service as described herein.

Termination by you

You may close your account at any time from the Settings page. Upon deletion, your content and data will be removed within 30 days per our Privacy Policy.

Termination by CASTD

We may suspend or terminate your account immediately, without prior notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent activity, or pose a security risk to the Service or other users. We will make reasonable efforts to notify you unless prohibited by law or the circumstances require immediate action.

Effect of termination

Upon termination, your right to use the Service ceases immediately. Sections relating to ownership, warranty disclaimers, limitation of liability, and dispute resolution survive termination.

The Service is provided "as is" and "as available" without warranty of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate.

To the fullest extent permitted by law, CASTD's total liability to you for any claim arising from your use of the Service shall not exceed the greater of (a) the amount you paid to CASTD in the 12 months preceding the claim or (b) $100 USD. We are not liable for any indirect, incidental, special, consequential, or punitive damages.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
